Terms of Use

You must be at least 13 years old to use this site, and at least 18 (or the age of majority where you live) to claim a listing or make a purchase. You agree to use the site only for lawful purposes and in line with these Terms and our Legal & Disclaimer notices.

You agree not to: scrape, copy or harvest the site or its listings in bulk; interfere with or overload the site; try to access systems or data you aren't allowed to; submit false, misleading, defamatory, hateful or unlawful content; impersonate any person or business; or use the site to send spam or unsolicited advertising.

You may only claim a listing for a business you own or are authorized to represent. We may ask you to verify ownership and may refuse, suspend or remove any claim at our discretion. Free claims go live only after we approve them. You are responsible for the photos, videos, offers and text you give us, and you confirm you have the rights to them and that they're accurate and lawful. You give us a non-exclusive, royalty-free license to display, edit for length or format, and share that content on this site and our social media channels for as long as the listing is active.

Some categories are not accepted in our directory, including real estate agents, massage businesses and adult entertainment. We may decline or remove any listing that we believe doesn't fit the site.

Paid plans are one-time payments for a fixed 6-month term — they are not subscriptions and do not renew automatically. Current plans are the $100 Service / Upgrade listing and the $600 “Waikiki's Pick” category-exclusive listing; a $100 listing may move to Waikiki's Pick by paying the difference, keeping the same end date. Prices are in U.S. dollars and may be shown in your local currency at checkout. Payments are processed securely by Stripe; we never see or store your full card number. When the term ends, the listing returns to a standard listing unless you purchase a new term.

Waikiki's Pick is limited to one business per category (food and drink by cuisine type) at a time. Exclusivity applies only to the Waikiki's Pick placement on this site; it does not prevent competitors from having free or $100 listings or appearing elsewhere on the site, in search, news or other content.

Because placement starts as soon as payment is confirmed, payments are generally non-refundable. If we can't verify your ownership, reject your listing, or a technical error on our side prevents your upgrade from going live, we will refund you in full. To request a refund or report a billing problem, use our contact form and choose “Payment or refund.” If we remove a listing for breaking these Terms, no refund is due.

The site's design, text, data compilations and branding are owned by LOCAL Waikiki or our licensors and protected by law. If you send us ideas or feedback, we may use them without any obligation to you.

We may change, suspend or discontinue any part of the site, its features or plan pricing at any time. Price changes don't affect a term you've already paid for. We may update these Terms; the “Last updated” date above will change, and continued use of the site means you accept the updated Terms.

The site is provided “as is.” The disclaimers and liability limits in our Legal & Disclaimer page are part of these Terms.

You agree to defend and hold harmless LOCAL Waikiki and its owners from claims, losses and costs (including reasonable attorneys' fees) arising from content you submit, your business, or your violation of these Terms or the law.

We may suspend or end your access to the site or remove any listing or content if we believe you have broken these Terms. Sections that by their nature should survive (such as ownership, disclaimers, indemnity and governing law) will survive termination.

These Terms are governed by the laws of the State of Hawaiʻi and applicable U.S. federal law. Before filing any claim, you agree to first try to resolve the dispute informally by contacting us through the contact form and giving us 30 days to respond. Any lawsuit must be brought in the state or federal courts located in Honolulu, Hawaiʻi. If any part of these Terms is found unenforceable, the rest remains in effect.
